Welcome to PichaPal (“Platform”, “we”, “us”, “our”). These Terms and Conditions constitute a legally binding agreement governing your access to and use of our photography and printing services.

By using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms.

1. Definitions

Photographer: Users uploading visual content for sale or distribution.

Customer: Users viewing, purchasing, or downloading photographs.

Event Album: Public/Private collections accessible via unique links or QR codes.

Subject: Any identifiable individual appearing in a Photo.

2. Platform Role

PichaPal operates as a digital marketplace and hosting provider. We do not commission, direct, or control the taking of photographs. Our role is limited to providing the infrastructure for photographers to reach customers and fulfill print orders.

3. Photographer Obligations

Critical Warranty:

Photographers represent that all identifiable Subjects have provided valid and informed consent for photography, display, and sale, as required by the Kenya Data Protection Act.

Photographers must be the lawful copyright owner of all uploaded content.
No content may infringe on intellectual property or depict minors without verifiable parental consent.
Photographers indemnify PichaPal against all legal costs arising from breaches of these warranties.

4. Customer Usage Rights

When you purchase a photo from PichaPal:

Usage is restricted to personal, non-commercial use.
You may print the photo for personal display only.
Resale, redistribution, or commercial publication is strictly prohibited without explicit authorization.

5. Subject Rights & Takedowns

In accordance with privacy rights, any Subject appearing in a Photo may request removal of said content. PichaPal reserves the right to suspend or remove content immediately pending verification of such requests.
